TRANTOR-New Horizons in SCSI Design SOFTWARE LICENSE AGREEMENT
IMPORTANT*
YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE OPENING OR USING THIS
PRODUCT. IT CONTAINS SOFTWARE (“Software Program”). THE USE OF WHICH IS LICENSED BYTRANTOR SYSTEMS.
LTD. ("Tramor”), TO ITS CUSTOMERS FOR THEIR USE ONLY AS SET FORTH BELOW. OPENING THIS PACKAGE INDI­
CATES THAT YOU ACCEPT THE TERMS OF THIS AGREEMENT. IF YOU DO NOT ACCEPT THESE TERMS, RETURN
THIS PACKAGE UNOPENED WITHIN A REASONABLE TIME AND YOUR MONEY WILL BE REFUNDED.
TERMS AND CONDITIONS
You may: 1. Use the software program on a single personal computer. 2. Make one (1) copy of the program for backup or modification
purposes in support of your internal use of the program. This software program is copyrighted. Unauthorized copying of the software pro­
gram, including software that has been modified, merged or included with other software ¡s forbidden. 3. Modify and/or Merge the pro­
gram into another program for your use on a single computer. Any portion of this program merged into another program will continue to

subject to the terms and conditions of the Agreement.* 4. Transfer the program and license to another party it the other party agrees to
accept the terms and conditions of this Agreement. If you transfer the program, you must at the same time either transfer any copy to the
same party or destroy any copy not transrerred; this includes all modifications and portions of the program contained or merged into other
programs. Any authorized transferee of the Software Program shall be bound by the terms and conditions of this Agreement.
(*) You must reproduce and include the copyright notice on any copy, modification or portion merged into another program.
Uses not permitted:
1. Except as expressly provided for in this license, you may not use, copy, modify, adapt, translate, reverse engineer, decompile, disassemble
or create derivative works.
OWNERSHIP
Trantor reserves the right and title to this software product, and all subsequent copies including title to this Software Program and to the
medium on which it is encoded. You have purchased only a license to use this copy, which is leased to you by Trantor. TRANTOR
OWNS THIS COPY AND ALL BACK-UP COPIES; YOU ONLY HAVE THE LIMITED RIGHTS GRANTED BY THIS LICENSE.
TERM
The license is effective until terminated. THIS LICENSE WILL TERMINATE AUTOMATICALLY WITHOUT NOTICE FROM
TRANTOR IF YOU FAIL TO COMPLY WITH ANY PROVISION OF THIS LICENSE. You agree upon such termination to destroy
the program together with all copies, modifications and merged portions in any form.
DISCLAIMER OF WARRANTY AND LIMITED WARRANTY
THE SOFTWARE PROGRAM IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO
THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE,
YOU (AND NOT TRANTOR) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
FURTHER, TRANTOR DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE
USE. ORE THE RESULTS OF THE USE. OF THE SOFTWARE PROGRAM IN TERMS OF CORRECTNESS. ACCURACY,
RELIABILITY, CURRENTNESS, OR OTHERWISE.
Trantor warrants the diskette (s) on which the program is furnished to be free from defects in materials and workmanship under normal use
for a period of ninety (90) days from the date of delivery to you as evidenced by a copy of your receipt.
THE ABOVE ARE THE ONLY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIM­
ITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
LIMITATIONS OF REMEDIES
Trantor’s entire liabili^ and your exclusive remedy shall be:
1. The replacement or any diskette not meeting Trantor’s “Limited Warranty” and which is returned to Trantor with a copy of your
receipt, or
2. IfTrantor is unable to deliver a replacement diskette which is free of defects in materials or workmanship, you may terminate this
Agreement by returning the program, and your money will be refunded.
3. If failure of the diskette has resulted from accident, misuse or misapplication, Trantor shall have no responsibility to replace the diskette
or refund the purchase price.
4. Any replacement diskette will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
IN NO EVENT WILL TRANTOR BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAV­
INGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE
SUCH SOFTWARE PROGRAM. EVEN IF TRANTOR OR ANY AUTHORIZED TRANTOR DEALER HAS BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
This agreement will be governed by the laws of the State of California.
You acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. You further agree
that it is the complete and exclusive statement of this Agreement between us which supersedes any proposal or prior agreement, oral or
written, and any other communications between us relating to the subject matter of this Agreement.
