13.3 Entire Agreement. These Terms of Service together with the End User License
Agreement constitute the entire agreement between You and Skype with respect to
the subject matter hereof and will supersede and replace all prior understandings
and agreements, in whatever form, regarding the subject matter.
13.4 Partial Invalidity. Should any term or provision hereof be deemed invalid, void
or enforceable either in its entirety or in a particular application, the remainder of
these Terms of Service shall nonetheless remain in full force and effect.
13.5 No waiver. Skype does not guarantee we will take action against all breaches
of these Terms of Service. The failure of Skype at any time or times to require
performance of any provisions hereof shall in no manner affect its right at a later
time to enforce the same unless the same is explicitly waived in writing and signed
by Skype.
13.6 No Assignment by You. You are not allowed to assign this contract or any rights
hereunder.
13.7 Assignment by Skype. Skype is allowed to, at its sole discretion, assign this
contract or any rights hereunder to any affiliate, without giving prior notice.
13.8 Applicable Law. The Agreement shall be governed by and construed in accordance
with the laws of Luxembourg without giving effect to the conflict of laws
provisions of Luxembourg or Your actual state or country of residence.
13.9 Competent Court. Any legal proceedings arising out of or relating to Agreement
will be subject to the jurisdiction of the courts of the district of Luxembourg.
13.10 Language. The original English version of this Agreement may have been
translated into other languages. In the event of inconsistency or discrepancy
between the English version and any other language version of this Agreement, the
English language version shall prevail.
SKYPEOUT SERVICE
The provisions set forth in this Chapter ‘SkypeOut Service’ shall, in addition to the
General Conditions of these Terms of Service, apply if Skype provides You SkypeOut
service.

Article 14
EMERGENCY CALLS
14.1 No emergency calls. You expressly acknowledge and agree that the VoIP service
provided by Skype does not and is not intended to support or carry emergency calls
to any type of hospitals, law enforcement agencies, medical care unit or any type of
emergency services of any kind and that Skype is not liable in any manner for such
calls. In the event that, with Your permission, another user uses Your Account or
Skype Group member Account, You are responsible to inform that user that it is not
possible to support or carry emergency calls with the Skype VoIP service.
