IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR

NEITHER PANASONIC, PANASONIC’S SUPPLIER NOR FWB SHALL BE LIABLE
FOR ANY DAMAGE SUFFERED BY YOU INCLUDING, BUT NOT LIMITED TO,

CONSEQUENTIAL, INCIDENTAL SPECIAL OR PUNITIVE DAMAGES. THE ABOVE

LIMITATIONS SHALL APPLY REGARDLESS OF THE FORM OF ACTION

WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT

LIABILITY OR OTHERWISE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE

POSSIBILITY OF SUCH DAMAGES.

5. U.S. Government Restricted Rights

The SOFTWARE and documentation are provided with RESTRICTED RIGHTS. Use,

duplication or disclosure by the Government is subject to restrictions as set forth in
subparagraph (c)(1 ){A) of the Rights in Technical Data and Computer Software clause
at DFARS 252.227-7013

subparagraph (c)(1) and (c)(2) of the Commercial Com

puter Software -- Restricted Rights at 48 CFR 52.227-19, as applicable. Manufacture

tor is Panasonic.

6. U.S. Export Control

You agree and certify that neither the SOFTWARE will be transferred or reexported,
directly or indirectly, into any country where such transfer or reexport is prohibited by
the U.S. Export Administration Act and Regulations thereunder, without the proper
authorization of U.S. Government, if required.

7. Control Law

This Agreement is governed by the law of Japan.
